This paper engages with the artistic practice and work of Vanessa Dion Fletcher from my perspective as a non-Indigenous academic and curator. Dion Fletcher and I have worked together over the past several years through discussions about her work, studio visits, and various events. In her art practice, Dion Fletcher uses porcupine quills and menstrual blood to inquire into a range of issues and concepts including Indigenous language revitalization, feminist Indigenous corporeality, Land as (...) pedagogy, decolonization, and neurodiversity. In particular her work confronts the ways that Indigeneity, the queer and gendered body, and disability are rendered expendable. In this paper I engage with Dylan Robinson’s “sovereign sense”: a transcorporeal mode of perception that is affective, land-based, and formed through relations between human and non-humans. Dion Fletcher’s work makes palpable this sense of sovereignty through its unruly and mutating feltness. Further, her work makes visible feminist Indigenous artistic acts of resurgence alongside the frictions at the intersections of settler colonialism and disability. Following Karyn Recollet, I contend that Dion Fletcher’s work activates an Indigenous affective experience of futurity and creative intimacy that in turn imagines disability and Indigeneity as sites through which new pedagogical relations can be formed. The conflict which has tended recently to crystallize in particular around the name of Martin Heidegger goes back a long way. Where do philosophers stand in relation to political and social reality? What assistance can their problems and insights offer the process of coming to terms with this reality? In the context of the discussions surrounding Farias's book I set out my own position in Paris in November 1987; the full text was later published in German under the heading “Return (...) to Syracuse?” This title referred to the disappointment Plato felt in his own time when, at the invitation of the tyrant of Syracuse, that city's absolute ruler, he had twice gone to initiate the young prince in the basic principles of his thought concerning the just idea of the state and the just ordering of society. Things turned out badly and Plato had considerable difficulty getting back home again. Later still he was to suffer bitter disappointment when his intimate associate Dion, a member of the innermost circle of his academic community, was suddenly murdered by his own friends after heading a victorious operation to liberate Syracuse (one would like to know more about what lay behind that particular assassination). Resumo: A atuação do tradutor e intérprete de língua de sinais no contexto educacional inclusivo é tema de constantes embates teóricos acerca da concepção de seu ‘papel’. Desse modo, verificam-se prescrições que delimitam suas práticas e atribuições pela caracterização de uma pretensa ‘identidade’ profissional. Na contramão disso, esse estudo tenciona um adensamento analítico acerca daquilo que é produzido na atividade interpretativo-pedagógica do intérprete educacional, fora do âmbito da ‘identidade profissional’, mas no âmbito das efetivas ações produzidas pela posição e contextos (...) de ensino, assumidos na prática cotidiana. Assim, entende-se que essa função interpretativa se constitui na lógica da ‘diferença’, pela ativação relacional e pedagógica com o sujeito surdo no contexto escolar. A tese empreendida é a de que a função pedagógica do intérprete educacional é estabelecida como efeito do ato educativo. Nosso foco se dará na análise do aprender surdo e sua co-construção de conhecimento, produzidos com e pelos signos emitidos pelo intérprete educacional como efeito do acontecimento educativo. The role of the educational interpreter and deaf learning: an analysis of the master position in the educational relationship in an inclusive classroom Abstract: Sign language translators and interpreter’s part within inclusive education constantly rises theoretical debates about the conception of their 'role'. Thus, we commonly see prescriptions that delimit their practices and attributions by characterizing a supposed professional "identity". Nevertheless, this study aims to analyze what is produced in the interpretive-pedagogical activity of the educational interpreter, beyond the scope of 'professional identity', and within the effective actions produced by the position and context assumed on a daily basis. Thus, we understand that this interpretative function is constituted in the logic of 'difference', by relational and pedagogical activation with the deaf subject in the school context. The thesis undertaken is that the pedagogical function of the educational interpreter is established as an effect of the educational act. We focus on the analysis of deaf learning and its co-construction of knowledge, produced with and by the signs emitted by the educational interpreter as an effect of the educational event. Therefore, this article analyzes the conceptual movement of the master position from the studies of the hermeneutics of the subject, in Michel Foucault, assuming it as an articulator of the interpretative-pedagogical function of the educational interpreter that materializes in and through the teaching context. Apresenta-se resultados de uma pesquisa desenvolvida na área da educação de surdos, realizada no período de 2015 a 2017, com financiamento da Fundação de Amparo à Pesquisa do Estado de São Paulo. A investigação aconteceu em salas de aulas do ensino fundamental II, com a presença de alunos surdos e intérpretes educacionais, de uma escola municipal inclusiva no interior do estado de São Paulo. Percebe-se em que medida o percurso escolar anterior dos alunos surdos facilitaram a interação com os profissionais (...) tradutores e intérpretes de língua de sinais educacional. Conclui-se que os alunos surdos que passaram por salas bilíngues com a língua de instrução Libras, nos anos iniciais do ensino fundamental I, apresentaram uma melhor relação com os TILSE. (shrink)

Traditionally, logic has been the dominant formal method within philosophy. Are logical methods still dominant today, or have the types of formal methods used in philosophy changed in recent times? To address this question, we coded a sample of philosophy papers from the late 2000s and from the late 2010s for the formal methods they used. The results indicate that the proportion of papers using logical methods remained more or less constant over that time period but the proportion of papers (...) using probabilistic methods was approximately three times higher in the late 2010s than it was in the late 2000s. Further analyses explored this change by looking more closely at specific methods, specific levels of technical engagement, and specific subdisciplines within philosophy. These analyses indicate that the increasing proportion of papers using probabilistic methods was pervasive, not confined to particular probabilistic methods, levels of sophistication, or subdisciplines. The replicability crisis refers to the apparent failures to replicate both important and typical positive experimental claims in psychological science and biomedicine, failures which have gained increasing attention in the past decade. In order to provide evidence that there is a replicability crisis in the first place, scientists have developed various measures of replication that help quantify or “count” whether one study replicates another. In this nontechnical essay, I critically examine five types of replication measures used in the landmark article (...) “Estimating the reproducibility of psychological science” (Open Science Collaboration, Science, 349, ac4716, 2015) based on the following techniques: subjective assessment, null hypothesis significance testing, comparing effect sizes, comparing the original effect size with the replication confidence interval, and meta-analysis. The first four, I argue, remain unsatisfactory for a variety of conceptual or formal reasons, even taking into account various improvements. By contrast, at least one version of the meta-analytic measure does not suffer from these problems. It differs from the others in rejecting dichotomous conclusions, the assumption that one study replicates another or not simpliciter. I defend it from other recent criticisms, concluding however that it is not a panacea for all the multifarious problems that the crisis has highlighted. (shrink)

In this paper I argue that the Canberra Plan is ill-equipped to offer a satisfactory theory of gender. Insofar as the Canberra Plan aims to provide a general and unified approach to philosophical theorising, this is a significant problem. I argue that this deficit in their method stems from the robust role assigned to pre-theoretical beliefs in constructing philosophical analyses. I utilise a critical conception of ideology to explain why our pre-theoretic beliefs about certain social kinds are likely to deliver (...) politically dubious metaphysics of the social world. The first half of the paper is dedicated to exercising this theoretical shortcoming. In the second half, I suggest a way in which the Canberra Plan can address and rectify this problem, with a view to maintaining the theoretical viability of the Canberra Plan with respect to politically important concepts. If one is interested in reasoning counterfactually within a physical theory, one cannot adequately use the standard possible world semantics. As developed by Lewis and others, this semantics depends on entertaining possible worlds with miracles, worlds in which laws of nature, as described by physical theory, are violated. Van Fraassen suggested instead to use the models of a theory as worlds, but gave up on determining the needed comparative similarity relation for the semantics objectively. I present a third way, in (...) which this similarity relation is determined from properties of the models contextually relevant to the truth of the counterfactual under evaluation. After illustrating this with a simple example from thermodynamics, I draw some implications for future work, including a renewed possibility for a viable deflationary account of laws of nature. This editorial explains the themes of the forthcoming FLaK seminar and how those themes draw on the collective and individual contributions of the articles, interviews and commentaries presented in this issue. At FLaK, we propose to think with others about the kind of ‘kitchen table’ that FLS might provide into the future. How might feminist legal studies—the approach and the journal—best use its food, equipment, techniques, time, space, mood, energy and commitment? How shall FLS scholars and associates make the most (...) of what we have in a room that can sometimes be confining and confusing, yet also exciting and sustaining? How do others engage with the processes and products of our kitchen table? In considering these issues and more, we propose to draw reflexively on feminist legacies of praxis, internationalism and openness, as we stock up and critically reflect on decolonizing techniques, legal know-how, protest and publishing practices. A common starting point for ‘going hybrid’ is the thought that moral discourse somehow combines belief and desire-like aspects, or is both descriptive and expressive. Hybrid meta-ethical theories aim to give an account of moral discourse that is sufficiently sensitive to both its cognitive and its affective, or descriptive and expressive, dimensions. They hold at least one of the following: moral thought: moral judgements have belief and desire-like aspects or elements; moral language: moral utterances both ascribe properties and express desire-like (...) attitudes. This entry concerns hybrid theories of moral language. The main division within such theories is between those treating the expression of desire-like attitudes as semantic and those treating it as pragmatic. This entry exclusively focuses on pragmatic forms of and examines the prospects for treating moral attitude expression as working via certain standard pragmatic mechanisms. I explain these mechanisms, outline the properties that standardly define them, and test to see whether moral attitude expression matches them. At the end, I briefly explain a more minimal pragmatic alternative. The main conclusions are that we should disregard presupposition and conventional implicature views and that the most plausible options for a pragmatic hybrid view are a generalised conversational implicature view and a more minimal pragmatic view. Modernity has been working since the sixteenth century in western Europe at what Mr. Gauchet has described as the “exit from religion,” adding that Christianity alone has been able to gain the historical position of “the religion of the exit from religion.” It is indeed the case that the other great religions have not felt, as Christianity has, the intellectual, political and legal necessity to revise their theological foundations radically. Islam in particular has not only been shielded from the fundamental (...) criticisms of intellectual and scientific modernity, but the managers of the sacred have formed alliances with nationalist movements engaged in the anti-colonialist struggle to legitimize wars of liberation and post-independence one-party states. It is true that Islam's mechanisms of state control first came into play in the period of prose-lytism of the new religion, chiefly between 622 and 632; but state control turned into the complete takeover of the irreducible autonomy of the religious domain (the spiritual sphere) by all the states that emerged after the 1920s (Ataturk's radical experiment) and even more so after the post-1945 liberations. Recently, Horsman et al. have proposed a new framework, Abstraction/Representation theory, for understanding and evaluating claims about unconventional or non-standard computation. Among its attractive features, the theory in particular implies a novel account of what is means to be a computer. After expounding on this account, I compare it with other accounts of concrete computation, finding that it does not quite fit in the standard categorization: while it is most similar to some semantic accounts, it is not itself a semantic (...) account. Then I evaluate it according to the six desiderata for accounts of concrete computation proposed by Piccinini. Finding that it does not clearly satisfy some of them, I propose a modification, which I call Agential AR theory, that does, yielding an account that could be a serious competitor to other leading account of concrete computation. Scientific editors’ policies, including peer review, are based mainly on tradition and belief. Do they actually achieve their desired effects, the selection of the best manuscripts and improvement of those published? Editorial decisions have important consequences—to investigators, the scientific community, and all who might benefit from correct information or be harmed by misleading research results. These decisions should be judged not just by intentions of reviewers and editors but also by the actual consequences of their actions. A small but growing (...) number of studies has put editorial policies to a strong scientific test. In a randomized, controlled trial. blinding reviewers to author and institution was usually successful and improved the quality of reviews. Two studies have shown that, contrary to conventional wisdom, reviewers early in their careers give better reviews than senior reviewers. Many studies have shown low agreement between reviewers but there is disagreement about whether this represents a failing of peer review or the expected and valuable effect of choosing reviewers with complementary expertise. In a study of whether manuscripts are improved by peer review and editing, articles published in Annals of Internal Medicine were improved in 33 of 34 dimensions of reporting quality, but published articles still had room for improvement. Because of the central place of peer review in the scientific community and the resources it requires, more studies are needed to define what it does and does not accomplish. (shrink)

European and international regulation of human health research is typified by a morass of interconnecting laws, diverse and divergent ethical frameworks, and national and transnational standards. There is also a tendency for legislators to regulate in silos—that is, in discrete fields of scientific activity without due regard to the need to make new knowledge as generalisable as possible. There are myriad challenges for the stakeholders—researchers and regulators alike—who attempt to navigate these landscapes. This Delphi study was undertaken in order to (...) provide the first interdisciplinary and crosscutting analysis of health research regulation, as it is experienced by such stakeholders in the UK context. As well as reinforcing existing understandings of the regulatory environment, Delphi participants called for greater collaboration, and even co-production, of processes involved in health research regulation. On the basis of this research, we offer insights about how health research regulation can become a matter with which a wider range of stakeholders—including researchers, regulators, publics and research sponsors—can engage. The evidence supports the normative claim that health research regulation should continue to move away from strict, prescriptive rules-based approaches, and towards flexible principle-based regimes that allow researchers, regulators and publics to co-produce regulatory systems serving core principles. By unpacking thorny concepts and practices at the heart of health research regulation—including the public interest and public engagement—our results have the potential to situate and breathe life into them. The results also demonstrate that while proportionality is well-recognised as a crucial element of flexible regulatory systems, more must be done to operationalise this as an ethical assessment of the values and risks at stake at multiple junctures in the research trajectory. This is required if we are to move beyond proportionality as a mere risk-management tool. Compliance culture no longer accurately reflects the needs and expectations of researchers or regulators, nor does it necessarily produce the best research. Embracing uncertainty—both as a human practice and a regulatory objective—may represent the brighter future for health research. (shrink)

Feminists witness legal worlds as they observe, document and share nothing less than the reproduction of life itself. The world of the abortion trail, where people and things move across borders to change life’s reproduction, has generated a rich variety of legal sources, figures and objects for feminist witnessing. In watching how feminist activists improvise with sources, figures and objects of legal consciousness on the abortion trail, this article seeks to contribute to critical understanding of a plurality of witnessing practice, (...) particularly as it emerges in diaspora space. Focusing on Murphy’s concept of immodest witnessing, with its attention to bodies, protocols and apparatuses as constituents of knowledge, the article thinks with the diasporic feminist performance group, Speaking of I.M.E.L.D.A., about how they used self-examination, collaboration and knowledge-sharing on the trail to repeal Ireland’s 8th Amendment. The article argues that their improvisation with legal consciousness of reproductive choice enacts ‘cheeky witnessing’. Cheeky witnessing has three dynamics as a method of observation. First, it is messy and irreverent in innovating with names to display the mixed genealogies of feminist knowledge. Second, cheeky witnessing generates novel subject-figures who make connections between different reproductive labourers as observers of the trail in diaspora space. Third, cheeky witnessing places funny objects, knickers in this instance, so as to join up particular public locations and make them more, if unevenly, comfortable for sexual and reproductive bodies. Cheeky witnessing shows us how committed and partial practices play a role in speaking across interests and experiences, in stretching the legal imagination and in sustaining the everyday grind of making a better world. This article evaluates various aspects of the selection interview in terms of the major principles of business ethics. It looks at both interviewer and interviewee behavior and examines the ethical questions that arise around five key themes: Preparation for the interview; Openness, disclosure and the invasion of privacy; Honesty and impression management; Power relationships in the interview; The use of interview information in decision making. It is argued that clear guidelines for ethical behavior in the interview are needed and would (...) actually serve to increase the effectiveness of the method. Various topics that require empirical investigation are identified, and some parallels drawn with research on other assessment methods. (shrink)

As the potential for the first human trials of somatic cell gene therapy nears, two ethical issues are examined: (1) problems of moral choice for members of institutional review boards who consider the first protocols, for parents, and for the clinical researchers, and the special protections that may be required for the infants and children to be involved, and (2) ethical objections to somatic cell therapy made by those concerned about a putative inevitable progression of genetic knowledge from therapy to (...) mass genetic engineering in human reproduction. The author's viewpoint is that a consensus exists on the required moral approach to somatic cell therapy, but that no moral approach yet exists for experiments beyond this level, especially in the germline cells of human beings. Health care reform in the United States and United Kingdom has resulted in the cross-fertilization of policy. The “new” health care models adopted by the two jurisdictions utilize free market principles for reasons of quality, efficiency, and cost, but also feature characteristics of a state-run model, through the provision of a safety net for citizens and a buffer against the commodification of health. In this sense, the health care systems of the US and UK are more congruent than they were. (...) Here we identify two distinct narratives that emerge from health care reform undertaken in these jurisdictions. The “revolutionary” narrative views the reforms as fundamental change whilst the “evolutionary” narrative accepts them as natural development. We argue that neither the revolutionary nor the evolutionary narrative adequately characterizes the reforms undertaken in health care because neither takes sufficient account of the broader setting in which reform has occurred. In seeking to examine and explain the jurisdictions' apparent drive to the middle, we propose a distinctive evolutionary narrative, that of “convergence,” which, as well as adopting a less parochial perspective on developments in health care policy and provision, also situates the reforms politically, constitutionally, and comparatively. Two narratives have emerged to describe recent health care reforms in the United States of America and the United Kingdom. One narrative speaks of revolution, that the adoptions of the Affordable Care Act 2010 in the US, and the Health and Social Care Act 2012 in the UK, have resulted in fundamental, large-scale philosophical, political and legal change in the jurisdictions’ respective health care systems. The other narrative evokes evolution, identifying each new legislative scheme as a natural development of existing (...) governance structures. Policymakers in both the US and UK face the problem of a health care system which, as traditionally envisaged, cannot offer universal access to health care at a reasonable, or politically acceptable, price. As visual technologies become increasingly networked online, websites like YouTube provide a space to share vlogs online, suggest related content for viewers, and help in/form virtual communities, including those of mental illness. Within this space, vlogs of schizophrenia and comments generated about them by other users can represent transitional, dialogical states of illness that speak back to the analog body and affect a body’s way of being in the world. Moreover, as vlogs create resistance against static definitions of schizophrenia, they (...) may foster a creativity, experimentation, and inventiveness that transforms understandings of schizophrenia within the sciences and humanities. : Despite the historical importance of Francis Bacon's grand vision of science, the doctrine of Form that supports his program of works is now generally agreed to be incoherent. This paper will argue, however, that Bacon's belief in the convertibility of matter gains a previously unacknowledged coherence when approached through the treatment of axiom conversion expressed in Ramus' 1574 Dialectica. Ultimately this will lead to the conclusion that Bacon did not--like most twentieth-century philosophers--see the universe as a collection of matter (...) understood by humans in terms of law, but as a collection of laws understood in terms of matter. Attitudes toward collective guilt in the Middle East require us to take a closer look at guilt in the Bible. It turns out the text of Genesis is conflicted. Some passages support a theory of guilt linked with the inevitability of cleansing and punishment; other passages appear to treat guilt as a psychological state that might be cured by a confession of sins. The tension is important today in trying to understand whether the collective guilt of nations should also entail (...) collective punishment. (shrink)

Mapping the paths that stem and progenitor cells take en route to differentiate and elucidating the underlying molecular controls are key goals in developmental and stem cell biology. However, with population level analyses it is difficult − if not impossible − to define the transition states and lineage trajectory branch points within complex developmental lineages. Single‐cell RNA‐sequencing analysis can discriminate heterogeneity in a population of cells and even identify rare or transient intermediates. In this review, we propose that using these (...) data, one can infer the lineage trajectories of individual stem cells and identify putative branch points. Clonal lineage tracing of stem cells allows one to define the outcome of differentiation. Integrating these single cell‐based approaches provides a robust strategy for establishing and testing models of how an individual stem cell changes through time to differentiate and self‐renew. A unique feature of flowering plants is their ability to produce organs continuously, for hundreds of years in some species, from actively growing tips called apical meristems. All plants possess at least one form of apical meristem, whose cells are functionally analogous to animal stem cells because they can generate specialized organs and tissues. The shoot apical meristem of angiosperm plants acts as a continuous source of pluripotent stem cells, whose descendents become incorporated into organ primordia and acquire different fates. (...) Recent studies are unveiling some of the molecular pathways that specify stem cell fate in the center of the shoot apical meristem, that confer organ founder cell fate on the periphery, and that connect meristem patterning elements with events at the cellular level. The results are providing important insights into the mechanisms through which shoot apical meristems integrate cell fate decisions with cellular proliferation and global regulation of growth and development. The theoretical inquiry into the foundations of criminal law in the twentieth century, in both civil and common law traditions, is assayed by the consideration of seven main currents or trends. First, the structure of offenses is examined in light of the bipartite, tripartite, and quadripartite modes of analysis. Second, competing theories of culpability - normative and descriptive - are weighed in connection with their important ramifications for the presumption of proof and the allocation of the burden of persuasion on (...) defenses. Third, the struggle with alternatives to punishment for the control and commitment of dangerous but non-criminal persons is compared in civil and common law approaches. Fourth, the ascendancy of feminism, as the most successful interdisciplinary school of thought applied to criminal law since the early 1970s, and its contributions in the areas of rape, self-defense, provocation, and capital punishment are charted and weighed. Fifth, one of the most distinctive facets of criminal theory in the last century has been the emergence of the victims' rights movement; its success is compared in civil and common law jurisdictions. Sixth, while it is commonplace in the civil law tradition to embed issues of criminal law within the principles of constitutional law, common law jurisdictions vary; the increasing constitutionalization of criminal law in Canada is contrasted with its decrease in the U.S. Seventh, against the backdrop of a particularly intense period of codification of the criminal law in the last half of the twentieth century, the celebrated American Model Penal Code is criticized.
